This policy explains what personal information Garden Solutions LLC (“Garden Solutions,” “we,” “us”) collects when you visit this website, buy a masterclass, a live class, one-to-one sessions or a book, sign up for our monthly letter, or write to us, and what we do with it. We collect only what we need, and we don’t sell it.
Template text: to be reviewed by a licensed US attorney before publication.
1. Who we are
Garden Solutions LLC is a California limited liability company located at 1734 W Sequoia Ave, Orange, CA 92868, United States. For any question about your personal information, email contact@gardensolutionss.com or call +1 614-729-8328.
2. Information we collect
We collect only the information we need to run the website and deliver what you buy.
- Order information: your name, email address, billing address, the products you buy and the amounts you pay.
- Shipping information, for books only: the recipient’s name, shipping address and phone number. The carrier may use the phone number to arrange delivery.
- Payment information: you enter your card details on our payment processor’s secure checkout page. They never reach our servers; we only receive the result of the payment, the card brand and the last four digits.
- Live classes: your name as it appears on Zoom, your voice and, if you turn on your camera, your image. These appear in the session recordings we share with the class.
- One-to-one sessions: the details you share about your garden, such as photos, measurements and plans, and the notes your mentor takes.
- Masterclass viewing data: the learning platform records when you sign in and how far you get through the lessons. We also use it to check refund eligibility.
- Monthly letter: the email address you sign up with and the page you signed up from.
- Messages: what you write to us about an order, a booking, a return or a refund, including attachments such as photos of a damaged parcel.
- Device and usage data: IP address, browser type, pages requested, and the date and time of each request, logged by our hosting provider for security and to keep the site running.
- Analytics and advertising data, only if you accept analytics and marketing cookies: pseudonymous browser identifiers and events such as pages viewed, items added to the cart and purchases, collected by Google Analytics and the Meta Pixel. Details are in our Cookie Policy.
- Cart: the items in your cart are stored in your browser’s local storage and reach us only when you start checkout.
3. How we use it
We use personal information only for the purposes below. We don’t use it to make automated decisions that have legal or similarly significant effects on you.
- To process and deliver your order: confirm your purchase, send masterclass access links, live class confirmations and Zoom links, and one-to-one booking links, ship books, and handle returns and refunds.
- To run live classes and one-to-one sessions, including recording live classes so participants can watch them later.
- To answer your questions and provide support.
- To send our monthly letter, if you signed up. Every letter includes an unsubscribe link.
- To understand how the website is used and how our ads perform, only with your consent.
- To keep the records that tax and accounting laws require, to prevent fraud and abuse, and to protect our rights.
4. Who we share it with
We don’t sell your personal information. We share it only with the service providers that help us run the business, under contracts that limit how they can use it, and in the other cases listed below.
- Stripe, our payment processor: processes payments, prevents fraud and sends receipts. For some purposes, such as fraud prevention and legal compliance, Stripe acts under its own privacy policy.
- Resend: sends our emails, including order confirmations, access and booking links, class emails and the monthly letter.
- Netlify: hosts this website and keeps its technical logs.
- Zoom: hosts our live classes and video sessions.
- The platforms we use to host masterclass lessons and to book one-to-one sessions.
- UPS: receives the recipient’s name, shipping address and phone number to deliver books.
- Google (Google Analytics) and Meta (Meta Pixel): only if you accept analytics and marketing cookies.
- Our accountants and legal advisors, and public authorities when the law requires it or when needed to protect our rights or the safety of others.
- A buyer or successor, if we sell or reorganize the business. Your information would remain subject to this policy.
5. Cookies and browser privacy signals
We use essential cookies and local storage to run the cart and remember your choices. Google Analytics and the Meta Pixel load only if you accept them. The full list, and the controls to change your choice, are in our Cookie Policy.
We honor Global Privacy Control (GPC). If your browser sends a GPC signal, we treat it as a request to opt out of the sale or sharing of your personal information and keep Google Analytics and the Meta Pixel off. We don’t respond to “Do Not Track” signals, because there is no common standard for them; GPC is the signal we support.
6. How long we keep it
We keep personal information only as long as we need it for the purposes above, then delete or anonymize it. If there is a dispute, we keep what’s relevant until it’s resolved.
- Orders, invoices and accounting records: 7 years, for tax purposes.
- Shipping address and phone number: 2 years after delivery, unless they are part of records we must keep.
- Live class recordings: for as long as they are available to the class, as described in our Terms of Service.
- One-to-one notes and materials: while your sessions are valid, plus 12 months, so your mentor can pick up where you left off if you come back.
- Monthly letter: until you unsubscribe. After that, we keep only your email address on a suppression list so we don’t write to you again.
- Support messages: 2 years after the last message.
- Hosting logs: up to 12 months.
- Analytics data: 14 months in Google Analytics.
- Your cookie choice: 12 months.
- Cart: in your browser, until you empty it or clear your browsing data.
7. How we protect it
The website uses encrypted connections (HTTPS), payments go through a PCI DSS-certified processor, and access to our systems is limited to the people who need it for their work. No system is perfectly secure, but if a security breach affects your personal information, we’ll notify you as required by law.
8. Your California privacy rights
If you live in California, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the “CCPA”), gives you the following rights:
- Right to know: you can ask what personal information we have collected about you, where it came from, why we use it, who we disclose it to, and for a copy of it.
- Right to delete: you can ask us to delete the personal information we collected from you, except what we must keep, for example for tax records or to complete your order.
- Right to correct: you can ask us to correct inaccurate personal information.
- Right to opt out of sale or sharing: we don’t sell personal information. If you accept marketing cookies, the Meta Pixel may count as “sharing” for cross-context behavioral advertising under California law. You can opt out at any time on our Cookie Policy page or by turning on Global Privacy Control in your browser.
- Right to limit the use of sensitive personal information: we don’t collect sensitive personal information as defined by the CCPA. Card numbers go directly to our payment processor.
- Right to non-discrimination: we won’t charge you a different price or give you a different level of service because you exercised any of these rights.
9. How to exercise your rights
Email contact@gardensolutionss.com, call +1 614-729-8328, or write to Garden Solutions LLC, 1734 W Sequoia Ave, Orange, CA 92868, United States. We’ll confirm that we received your request within 10 business days and respond within 45 days. If we need more time, up to another 45 days, we’ll tell you why.
To protect your information, we verify your identity by matching details you give us with our records, such as the email address and order number used for a purchase. You can also use an authorized agent: we’ll ask for proof that they are authorized to act for you, and we may ask you to confirm your identity directly with us.
If you live in another US state with a consumer privacy law, you can make the same requests in the same way, and we’ll respond as that law requires.
10. Categories of personal information (California notice)
In the past 12 months we collected these categories of personal information: identifiers (such as name, email address, postal address and IP address); customer records (such as billing and shipping details and phone number); commercial information (the products you bought); internet or other electronic network activity (pages viewed and interactions with the website, the analytics and marketing part only with your consent); and audio and visual information (live class recordings).
We collect it from you, from your device, and from our payment processor. We disclose it for business purposes to the service providers listed in section 4. We have not sold personal information. With your consent, identifiers and internet activity may have been shared with Meta for advertising. We don’t knowingly sell or share the personal information of consumers under 16.
California residents can also ask whether we disclosed personal information to third parties for their own direct marketing purposes in the prior calendar year (California Civil Code § 1798.83). We don’t make such disclosures.
11. Children
Our website and products are meant for adults, and you must be 18 or older to make a purchase. We don’t direct our services to children under 13 and don’t knowingly collect their personal information. If you believe a child under 13 has given us personal information, email contact@gardensolutionss.com and we’ll delete it.
12. Visitors outside the United States
We are based in the United States, and our service providers process and store information here. If you visit from another country, your information will be transferred to and processed in the United States, where privacy laws may differ from those where you live.
13. Changes to this policy
We update this policy when our service providers, our practices or the law change. The date at the top of the page shows the latest revision. If a change materially affects personal information you have already given us, we’ll email you before it takes effect.
